What Is The Deadline To File a Personal Injury Case in Georgia?

Each state has deadlines to file a claim for personal injury cases. In general, in Georgia you have two years to file a personal injury lawsuit in most cases. Georgia Code section 9-3-33 says: "Actions for injuries to the person shall be brought within two years after the right of action accrues." However, this deadline does not apply to everyone or every case. Some claimants and some cases have longer deadlines, and some have shorter filing deadlines. This deadline is called the statute of limitations.

The are many reasons why there may be shorter or longer deadlines:

  • You did not discover the extent of your injury until after the traumatic event occurred.

  • The claimant was injured as a minor and did not file a lawsuit until they turned 18.

  • A mental disability or illness prevented you from filing your case within the two-year period.

  • The defendant left the state, and they couldn’t be “served” with the legal papers.

  • You didn’t know the defendant’s identity until after the accident occurred.
